Arbitration

Arbitration is a procedure in which a dispute is submitted, by agreement of the parties or by the order of court to one or more arbitrators, who are privately appointed judges, who make a binding decision on the disptanting parties. In choosing arbitration, the parties opt for a private dispute resolution procedure instead of going to court.

We are experienced in sitting as arbitrators, in both Institutional and ad-hoc arbitrations and also as counsels in arbitration matters.

Mediation and Conciliation

Mediation focuses on needs and interests of the disputants to arrive at the mutually acceptable and workable solutions. The process envisages the conflict de-escalation between disputing parties through assisted negotiation. The mediator acts as a catalyst and promotes the agreeable solution without making any suggestion.

Conciliators at the other hand, do promote settlements, wherein they even propose the solutions.

From August 2018, Mediation has been made mandatory for commercial disputes under Commercial Courts Act, 2015 ( as amended in 2018) where urgent interim relief is not required.

Online Disputes Resolution

Online Disputes Resolution is the mechanism for resolving disputes through the use of electronic communications and other modes of information and communication technology. ODR process is useful for disputes arising out of cross-border, low-value e-commerce transactions. This process is suitable for both Business to business as well as business to consumer transactions.
